Terms of Service
These Terms of Service (“Terms”) govern your use of the Humdinger app and website, operated by Stronger Software LLC (“Humdinger,” “we,” “us”). By using Humdinger, you agree to these Terms.
Eligibility
You must be at least 13 years old (or the minimum age required where you live) to use Humdinger. By using the app you confirm you meet this requirement.
Your account
You sign in with Apple or an email-based account. You’re responsible for activity under your account and for keeping your sign-in secure. You can delete your account at any time in the app (Settings → Profile → Delete account).
Acceptable use
You agree not to use Humdinger to:
- break the law, or infringe anyone’s rights;
- upload content that is illegal, harassing, hateful, or that you don’t have the rights to share;
- abuse, disrupt, or attempt to gain unauthorized access to the service or other users;
- misuse notifications or scoring to harass others.
Your content and the license you grant
You own the content you create — your events, scores, text, custom sounds, and drawings. To make the social loop work, you grant Humdinger a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display that content to the people you share it with, and as needed to operate and improve the service.
Because Humdinger is built on a shared, append-only history, content you contribute to another person’s event or canvas keeps working for them even after you delete your account or your Pro access ends. After you delete your account, that content is anonymized and no longer carries your name. We will not revoke content you’ve already shared into others’ events.
Humdinger Pro
The core social loop is free. Humdinger Pro is optional and enables creating custom content and advanced tools. You can get Pro in one of two ways: a monthly subscription, or a one-time lifetime unlock. Purchases are processed by Apple through the App Store and are subject to Apple’s terms; refunds are handled by Apple. Whichever you choose, if you create custom sounds and canvases you keep them even if your access later ends or a purchase is refunded or revoked.
Auto-renewing subscription
The monthly plan, Humdinger Pro (Monthly), is an auto-renewable subscription. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews each month at the price shown in the App Store unless you cancel it at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before each period ends. You can manage or cancel your subscription, and turn off auto-renewal, at any time in your App Store account settings (Settings → your name → Subscriptions); cancellation takes effect at the end of the current billing period. Prices are shown in the App Store before you buy. If you prefer not to subscribe, the one-time lifetime unlock is a single purchase that grants Pro permanently with no renewal.
Intellectual property
The Humdinger app, website, name, and logo are owned by Stronger Software LLC. These Terms don’t grant you any rights to our trademarks or branding.
Disclaimers
Humdinger is provided “as is,” without warranties of any kind. In particular, notifications and their custom sounds depend on iOS and your device settings: a custom sound does not override Silent mode, a Focus, or Do Not Disturb, and a just-downloaded sound may fall back to the default. We don’t guarantee that notifications are delivered instantly or that widgets show the very latest value at every moment.
Limitation of liability
To the fullest extent permitted by law, Stronger Software LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of Humdinger. Our total liability is limited to the amount you paid us, if any, in the 12 months before the claim.
Termination
You can stop using Humdinger and delete your account at any time. We may suspend or terminate access that violates these Terms. See our Privacy Policy for how deletion affects your data.
Changes
We may update these Terms. We’ll update the date above when we do; continued use means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which Stronger Software LLC is organized, without regard to conflict-of-laws rules. (Final jurisdiction to be confirmed by counsel.)
